e-Discovery

By Ibptech

Electronic Discovery or e-Discovery are terms that address the electronic or digital components present in methods, tools, and procedures used in the identification, collection, and presentation of evidence in administrative, arbitral, or even judicial proceedings, as the parties may wish to follow their own rules in the space granted by the judge.

The information collected and used in this type of dispute is usually referred to collectively as Electronically Stored Information (ESI) and can originate and be organized in very diverse digital formats, such as: text, drawings, spreadsheets, sounds, images, videos, messages, attachments, databases, application system content, websites, social networks, and digital services, among many other resources.

The procedures for identifying, collecting, and presenting this information must comply with current regulations and follow best technical practices, under the risk of not being admitted as evidence, violating judicial orders, or even raising suspicions of procedural fraud.

Refer to the specific IBPTECH portal on E-Discovery.
